Chapter 961 of the state’s Uniform Controlled Substance Act also supports this, stating that hemp-derived products, including Delta-8, are consumable.

Vermont

Vermont Hemp Rules pays more attention to how manufacturers formulate Delta-8 from hemp-containing CBD. Since chemicals are used in this process, the state considers Delta-8 a synthetic component that may be dangerous.

Texas

Hemp products with less than 0.3% THC amounts are legal in Texas. However, the state’s Health and Safety Code Chapter 443(HSC 443) states that Delta-8 and Delta 9 products with THC amounts exceeding 0.3% are illegal.

South Carolina

Oregon

Chapter 604, Division 48 of the state’s Industrial Hemp Legislation identifies hemp-derived Delta-8 as consumable goods. However, the Industrial Hemp Legislation only defines hemp products with less than 0.3% THC level as legal. The state’s HB3000 is also not against synthetic cannabinoids, including hemp-derived Delta-8 THC. However, this bill does not allow unlicensed marijuana processors to process and sell Delta-8 products for public use.

North Dakota

North Dakota’s HB1045 does not identify hemp products as agricultural commodities. This explains why Delta-8 and Delta-9 THC are still on the state’s-controlled substance list. That said, it is illegal to deal with Delta-8 in any way.

Nebraska

The state of Delta-8’s legality in Nebraska is complicated. According to the Nebraska Hemp Farming Act, hemp products should be removed from the controlled substances list. This conflicts with Chapter 20 of the Uniformed Controlled Substances Act that claims the state should add hemp derivatives, isomers, cannabinoids, and extracts to the controlled substances list.

Michigan

Michigan also has conflicting laws connected to hemp and its plant parts. The state’s HB6330 and the Public Health Code do not agree about the legality of hemp products, including Delta-8.
